Terms of Service

These Terms of Service ("Terms") govern your use of the NameRoot mobile application ("App", "Service") published by Dinesh ("Developer", "we", "us", "our"). By downloading, installing, or using NameRoot, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use NameRoot. NameRoot is designed for parents and expectant parents. By using the App, you represent that you meet this age requirement.

2. Account & Registration

• NameRoot creates an anonymous account for you automatically on first launch. No personal information is required to start using the App.
• You may optionally link a Google account or Sign in with Apple to enable purchase restoration across devices.
• You are responsible for maintaining the security of your device and account credentials.
• You may delete your account and all associated data at any time from Settings → Delete Account.

3. The Service

NameRoot provides a baby name discovery and scoring platform. The core features include:

• Name Compatibility Index (NCI): A proprietary scoring engine that evaluates baby names across 6 signals — phonetic harmony, numerological alignment, nakshatra (birth star) compatibility, semantic meaning, uniqueness, and cultural & tradition fit — personalised to your family profile.
• AI-Generated Content: Baby portrait illustrations and name facts generated by artificial intelligence.
• Name Shortlist: Save, compare, and share baby names with family.

4. Free & Premium Tiers

Free Tier

• Browse up to 15 baby names per day with basic information (name, meaning, origin).
• Daily quota resets at midnight in your local timezone.
• NCI compatibility scores are hidden behind the paywall.

Premium (One-Time Purchase)

• Unlimited name browsing with no daily limit.
• Full 6-signal NCI compatibility scores and detailed breakdowns.
• AI-generated baby portraits for every name.
• Cultural facts, origin details, and name variants.
• Premium is a one-time, non-recurring purchase. There are no subscriptions, monthly fees, or auto-renewals.

5. Payments & Refunds

• All purchases are processed through the Apple App Store (on iOS) or Google Play Billing (on Android). Prices are displayed in your local currency as determined by the platform.
• We do not collect, process, or store your payment method details (credit card, UPI, etc.).
• Refunds are governed by the policies of the platform you purchased through: Apple's refund policy for App Store purchases, or Google Play's refund policy for Play Store purchases.

6. AI-Generated Content

• Baby portrait illustrations are AI-generated artistic renderings. They are not photographs of real babies and do not represent the actual appearance of any child.
• Name facts, cultural insights, and meanings are generated by AI and may contain inaccuracies or errors. They are provided for informational and entertainment purposes only.
• The NCI compatibility score is a computed index based on phonetic, numerological, astrological, and cultural analysis. It is not a scientifically validated measure and should not be the sole basis for naming decisions.
• Nakshatra calculations use an astronomical ephemeris with ±0.5° accuracy. For critical astrological decisions, consult a qualified pandit or astrologer.
• You should not rely exclusively on any AI-generated content or compatibility score for important life decisions.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Circumvent or attempt to circumvent the free-tier limitations, purchase verification, or any security measures.
• Use automated tools, bots, or scripts to interact with the App.
• Submit offensive, hateful, or inappropriate content through any input field (e.g., custom name entry, partner invite).
• Impersonate another person or provide false information.
• Use the App in any way that could damage, disable, or impair the Service.

8. Intellectual Property

• The NameRoot name, logo, NCI scoring engine, and all original content are the intellectual property of the Developer.
• AI-generated portraits are created for your personal use. You may share them via the App's built-in sharing features. You may not use them for commercial purposes.
• Baby names themselves are not owned by anyone — NameRoot does not claim ownership of any name in its corpus.
• User-generated content (custom names, ceremony details) remains your property.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using NameRoot, you consent to the practices described in the Privacy Policy.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• NCI scores, nakshatra calculations, or AI-generated content will be accurate, complete, or reliable.
• The App will meet your specific requirements or expectations.
• Any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use or inability to use the App.
• Any decisions made based on NCI scores, AI-generated content, or nakshatra calculations.
• Unauthorised access to or alteration of your data.
• Any third-party conduct or content on the Service.

Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid for the App (if any).

12. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

13. Third-Party Services

The App integrates with third-party services to provide its core functionality (including secure cloud storage, in-app purchase management, AI-generated content, and platform-level payment processing). Your use of these services is subject to their respective terms and privacy policies, summarised in our Privacy Policy. We are not responsible for the practices of third-party services.

14. Termination

• You may stop using the App and delete your account at any time.
• We reserve the right to suspend or terminate your access to the App if you violate these Terms, with or without notice.
• Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Disclaimer, Limitation of Liability, and Indemnification) will survive.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via an in-app notification at least 14 days before they take effect. Your continued use of the App after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the App.

16. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation.
• If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
• Nothing in these Terms affects your statutory rights under applicable consumer protection laws in your jurisdiction.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
